Brodcastr AI provides an AI-powered video creation and distribution system. We grant you a non-exclusive, non-transferable license to use the software according to your subscription plan.

• Account Access After Cancellation/Refund: Upon cancellation or refund, your account will immediately transition to a "View Only" status for 7 days. During this 7-day period, you may log in solely to download your data. After this period, your account and all associated data will be permanently deleted.
• Eligibility: You must be at least 18 years old to use this service.
• Subscription: Access is provided on a subscription basis ($49/month or as per your selected plan).
• Billing: You will be billed in advance on a recurring cycle. You can cancel at any time through your dashboard. Please note that refunds are only available within the first 7 days of your initial subscription, as detailed in our Refund Policy. After this 7-day period, all sales are final and no refunds will be issued.

• Your Content & Asset Responsibility: You retain full ownership of the raw assets (videos, images, audio, text) you upload to Brodcastr AI. By uploading these assets, you represent and warrant that you own all necessary rights, licenses, and permissions to use and authorize Brodcastr AI to process these assets for video creation and distribution on your behalf. You agree that you are solely responsible for the legality, accuracy, and appropriateness of all assets you provide, and that Brodcastr AI is not responsible for any infringement of third-party rights arising from your uploaded content.
• AI Output: You own the rights to the videos generated by the third-party AI services (e.g. Google AI Studio, Kie AI) that you integrate with Brodcastr AI. Brodcastr AI acts as a conduit, sending your inputs to these providers and presenting their output to you. You are responsible for ensuring your use of these outputs complies with the terms of service of the respective AI providers.
• Prohibited Content: You agree not to use Brodcastr AI to create content that is illegal, promotes hate speech, involves non-consensual "deepfakes," or violates the terms of service of the social media platforms you post to.

All intellectual property rights in the Brodcastr AI software, its underlying technology, the "Brodcastr AI Playbook," and all associated documentation, trademarks, and content (excluding user-generated content and third-party AI outputs) are owned by Brodcastr AI. You are granted a limited, non-exclusive, non-transferable license to use these solely for the purpose of accessing and using the service as permitted by these Terms. You agree not to copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

Brodcastr AI integrates with external AI services such as Google AI Studio (aistudio.google.com) and Kie AI (kie.ai) to enable advanced content generation (images, videos, posts, texts, titles, descriptions, hashtags, etc.). To utilize these features, you are required to provide your own API keys for these third-party services. You acknowledge and agree that:

• API Key Provision: You are solely responsible for obtaining and managing your API keys for Google AI Studio, Kie AI, and any other integrated third-party AI services.
• Cost Responsibility: All costs associated with the usage of these third-party AI services (e.g. API calls, token usage, data processing) will be directly borne by you, according to the pricing models of the respective service providers. Brodcastr AI does not cover or refund these costs.
• Platform Role: Brodcastr AI acts solely as a platform that facilitates the connection and orchestration of your content creation, automation, and distribution across social media using these third-party services. We do not generate content directly using our own API keys for these services, nor are we responsible for the performance, availability, or terms of service of these external AI providers.

If Brodcastr AI facilitates the transfer of ownership of a Facebook Monetized Page to you, the following terms apply:

• Ownership Transfer: Upon successful transfer of the page to your control, full ownership and responsibility for the page, its content, and its compliance with Facebook's policies immediately transfers to you.
• Brodcastr AI Responsibility: Brodcastr AI's responsibility ceases upon the successful transfer of ownership. We are not responsible for any subsequent actions, performance, or issues related to the transferred page.

While we strive for 24/7 uptime, Brodcastr AI may be temporarily unavailable due to scheduled maintenance, unforeseen technical issues, or factors beyond our control. We will endeavor to provide advance notice of any planned downtime. You agree that Brodcastr AI will not be liable for any damages or losses incurred due to service interruptions or unavailability.

Brodcastr AI integrates with third-party platforms (TikTok, YouTube, Facebook, Amazon, etc.). You are responsible for ensuring your content complies with their specific community guidelines and monetization policies. We are not responsible if a third-party platform shadow-bans, suspends, or demonetizes your account due to your content choices.

To ensure a high quality of service for everyone, we may implement reasonable usage limits on AI generation and automated posting based on your plan. Attempting to bypass these limits via automated scripts or "botting" the software is grounds for immediate termination.

We provide a powerful tool and a proven playbook, but we do not guarantee specific financial results. Your success depends on your execution, niche selection, and market conditions. The service is provided "as is" without warranties of any kind.

Brodcastr AI provides powerful tools and a proven playbook designed to help you generate content and monetize it. However, we do not guarantee any specific level of earnings, views, or success. Any figures or examples mentioned on our website, in marketing materials, or within the playbook are illustrative only and should not be considered as guarantees or projections of actual earnings. Your success is dependent on various factors including your own efforts, skills, market conditions, and the quality of content you create. We are not responsible for any financial outcomes, positive or negative, that may result from your use of Brodcastr AI.

Brodcastr AI shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service or any third-party platform actions.

We reserve the right to suspend or terminate accounts that violate these terms. If we terminate your account for a violation, you will not be entitled to a refund.

These terms are governed by the laws of the jurisdiction in which Brodcastr AI operates.
